    The Appeals Court on Wednesday upheld the Criminal Court's decision to acquit businessman Noppadol Thammawattana of the murder of his elder brother and former Bangkok MP Hangthong 11 years ago.

    Hangthong was found dead on Sept 5, 1999 with a bullet in his head in Mr Noppadol's room at the family's mansion on Phahon Yothin road.

    The first autopsy conducted by police found suicide as the cause of Hangthong's death.

    The second autopsy, conducted by forensic experts led by Khunying Porntip Rojanasunan, then deputy director of the Central Institute of Forensic Science, pointed to the likelihood of murder. A Scottish forensic specialist, Adrian Linacre, of Strathclyde University, confirmed Khunying Porntip's murder theory. This led to Mr Noppadol being charged with conspiracy to murder his elder brother.

    Mr Noppadol fought back by inviting Henry Lee, an American forensic expert, to counter the murder findings, leading to the third autopsy performed by a team of about 10 doctors, which again found in favour of suicide.

    However, Mr Noppadol was indicted on a murder charge in January 2004.

    On July 28, 2007 the Criminal Court acquitted Mr Noppadol, 56, of murdering Hangthong on the grounds that there was insufficient evidence to find him guilty.

    The case was then taken to the Appeals Court.

    The Appeals Court on Wednesday upheld the lower court's verdict.
